网售处方药监管现状及对策研究

【摘要】在我国互联网+的大背景下，医药行业与电商的结合在所难免，网售处

方药也成为公众争议不断却同时无限潜力的创新模式。通过运用比较法、文献

分析法、综合分析法、对比分析法等，对国内外现状与制度的对比分析，通过

对网售药品监管现状存在的问题和网售处方药可行性的分析，逐步探索适合我

国国情的网售药品具体方法和方式，为我国政府制定相关政策提供参考和依据。

从而促进我国开放网售处方药的过程，以此提高国民获取和使用药品的便利。

一味否定网售处方药不仅会导致关联行业的发展受阻，同时也会增加新的监管

问题。但过早开放网上销售又与当前的社会风气和监管体系完善程度不符。我

国应该在逐步开放网售药品的同时逐步完善网售药品的监管体系，确保“处方

开具有理可依，药物去向有迹可循”。

Research on the supervision status and the countermeasures

of Chinese prescription drug sale online

[Abstract] Under the background of "Internet +", the combination of the

pharmaceutical industry and e-commerce is inevitable, and online sales of

prescription drugs have also become an innovative model with constant public

controversy, but still has unlimited potential. This paper uses literature analysis,

comparative analysis, comparative analysis, comprehensive analysis, etc. to conduct

research, collect reading materials and study texts, comparative analysis of the current

situation and systems at home and abroad, find out the problem and research the

feasibility, promotes the process of sellinng prescription drugs online in our country.

Improving the convenience of citizens to obtain and use medicines, and gradually

explores specific methods of online drug sales that suitable for China's national

conditions. Providing reference and basis for the Chinese government to formulate

relevant policies. We can not blindly denying online sales of prescription drugs, which

will not only hinder the development of related industries, but also increase new

regulatory issues.

However, the premature opening of online sales is inconsistent with the current

social atmosphere and the degree of the regulatory system. China should gradually

open up the online sale of medicines while gradually improving the supervision

system for online sale of medicines to ensure that "prescriptions are justified and

medicines can be traced."

摘要：

摘要在我国互联网背景下医药行业与电商结合成为必然网售处方药作为具潜力且存争议的创新模式成为研究重点。研究运用多种分析方法对国内外网售处方药现状与制度对比剖析监管问题与网售处方药可行性旨在探索适合我国的网售药品方式为政策制定提供参考促进开放进程提升国民购药便利。过早开放网售处方药与当前社会风气和监管体系完善程度不符一味否定网售处方药则会导致关联行业发展受阻增加新的监管问题。我国应逐步开放网售药品完善监管体系确保“处方开具有理可依药物去向有迹可循”。国外网售处方药经验丰富如美国政府、行业与消费者协作德国强制监管与群众义务结合英国双重认证与记录保留。我国网售处方药存在需求与供应、监管与政策、群众意识与工作人员素质、技术等多方面问题。为此提出以下建议：实现医用资源公开化与平均化；完善监管法律；做好医保系统与网上药店对接；发展网络问诊；提高群众意识。
